Not Guilty – Possession of a Controlled Substance in Illinois (Psilocybin Class 4 Felony)

As a result of a domestic disturbance last summer, IO found her apartment occupied by several Chicago Police Officers. She had called the police on her boyfriend, who was intoxicated and threatening to hurt her. When officers arrived they confronted the boyfriend who exclaimed “she’s got drugs in the apartment! I can show you.” He then led the officers to the apartment bathroom where he pulled some psilocybin (psychedelic mushrooms) out of the closet.

IO explained to us during our initial meeting that the drugs were actually her boyfriends and not hers. He was afraid of going to jail and concocted a story to save himself. Unfortunately, the officers believed him and arrested IO.

As of our initial investigation we took some photos of the bathroom where the drugs were recovered. Due to the layout of the apartment, it was impossible for the officer to have seen the boyfriend while standing outside the bathroom. The officer was shown these photos at trial, and admitted as much. She (the officer) admitted that she couldn’t see the boyfriend’s hands or most of his body. She also admitted that IO had never handled the drugs and that she didn’t know how the drugs got into the bathroom. FINDING OF NOT GUILTY
