Heroin Class 2 Felony – DISMISSED AT PRELIMINARY HEARING

BR retained our office this month to represent him at his Preliminary Hearing for Delivery of a Controlled Substance. Officers claimed to have witnessed BR participate in 2 suspected drug transactions. At the first court appearance, the officer failed to show for an unspecified medical reason. We demanded a preliminary hearing. The judge allowed the State one continuance. At the next hearing date the State was unable to procure the Illinois State Police Crime Lab Report specifying the testing an analysis of the alleged controlled substance. We refused to agree to another continuance. The judge denied the State’s Motion to continue and they were forced to dismiss the case.
