Robert J. Callahan and Associates won again today when our Motion to Dismiss was granted in a Civil Drug Asset Forfeiture case. Last June, K.S. had his car and $9000.00 in cash seized by the Kankakee Police Department. The seizure was pursuant to his arrest for possession of a controlled substance and a handgun.
The cash was discovered in K.S.’s car during the traffic stop. During the criminal case our Motion to Suppress Evidence was granted when the Judge ruled that the officers searched his car illegally. The weapons and narcotics cases were therefore dismissed. Thus, the State’s Attorney’s office was not allowed to use the controlled substance or the cash in the Civil Drug Asset Forfeiture Case. As a result, the cash, the car, and even his Glock 9 mm were returned to him!
