RR was arrested earlier this summer while seated in his car on Chicago’s south side. Officers approached him and claimed they could smell a strong odor of alcohol emanating from him and his car. He was ordered out of the car but refused to perform standardized field sobriety tests. During cross examination the officer seemed confused about the tickets RR was issued. He testified that RR had been issued a Moving Violation ticket. It was pointed out on cross examination that the officer had never actually observed RR driving.
