C.M. Was arrested on April 27, 2012 for the crime of Unlawful Use of Weapons. Chicago Police Officers detained C.M. after allegedly detecting an odor of cannabis emanating from his car. The officers searched the car and recovered a loaded .38 caliber revolver. Our investigation uncovered the fact that no cannabis was recovered from the vehicle. Furthermore C.M. was not inside or near the vehicle when police smelled the odor and did their search. On cross-examination police admitted that they never saw C.M handle the weapon, and that no marijuana was found. At the close of the State’s case, the judge found that the burden of proof had not been met. We didn’t even have to present evidence! Preparation as once again the key to success. Finding of NOT GUILTY.
